Terms and Conditions of Use
These Terms and Conditions of Use (the "Terms") govern access to and use of the Youmidor mobile application and website (together, the "Service"), published by Youmidor ("Youmidor", "we", "us"). By creating an account or using the Service, you acknowledge that you have read, understood and unreservedly accepted these Terms. If you do not agree to them, please do not use the Service.
1. Publisher and purpose
The Service is published and operated by Youmidor. The purpose of these Terms is to define the terms and conditions under which Youmidor makes the Service available to users, together with the resulting rules of use.
They constitute the entire agreement between you and Youmidor regarding the Service and supersede any prior statement or communication.
2. Definitions
- "Service": the Youmidor application, website and all of their features.
- "User": any natural person of legal age who holds an account or accesses the Service.
- "Account": the personal space created by the User to access the Service.
- "User Content": any content published by a User (tasting notes, reviews, photos, cigar bands, comments).
- "Connoisseur": the paid subscription plan granting access to advanced features.
3. Access and account
The Service is strictly reserved for persons of legal age (18 years and older). By using the Service, you represent that you have reached the legal age required in your country of residence.
Creating an account requires accurate and up-to-date information. You are solely responsible for maintaining the confidentiality of your credentials and for all activity carried out through your account. You undertake to notify us without delay of any unauthorized use.
4. Description of the Service
Youmidor offers, in particular, the cataloguing of a cigar collection, identification by photographing the cigar band, an artificial-intelligence-based assistant (the "sommelier"), a tasting journal, humidor management and community features.
The information provided (specifications, prices, peak-maturity windows, recommendations) is given for indicative purposes only and may contain inaccuracies or change over time. The Service does not sell tobacco and shall not be construed as a substitute for professional advice.
5. Free plan and Connoisseur subscription
The Service includes a free plan and a paid "Connoisseur" subscription unlocking additional features (unlimited scanning, unlimited sommelier, peak-maturity alerts, multiple humidors, ad-free experience).
- A free trial may be offered to new subscribers. At the end of the trial period, the subscription automatically continues at the then-current rate, unless cancelled before its expiry.
- Subscriptions taken out through Apple's App Store are billed, managed and renewed by Apple in accordance with its own terms. Management, modification and cancellation are carried out from your Apple account settings.
- Unless turned off at least twenty-four (24) hours before the renewal date, the subscription is automatically renewed for an identical term, and the renewal is charged within the twenty-four (24) hours preceding the end of the current period.
- Rates may change; any modification will be communicated to you and will take effect only for subscription periods following such change.
6. Right of withdrawal
Where the subscription is supplied as digital content whose performance begins immediately with your express consent, you acknowledge that you waive your right of withdrawal once performance has begun, within the limits provided for by applicable law.
For purchases made through the App Store, refund requests fall exclusively within the remit of Apple and its terms.
7. User Content
You retain ownership of your User Content. By publishing it, you grant Youmidor a worldwide, non-exclusive, royalty-free licence to host, reproduce and display it solely for the purposes of operating and promoting the Service.
You warrant that you hold all necessary rights in your Content and that it does not infringe the rights of any third party. Unlawful, defamatory, misleading content, or content contrary to public policy, is in particular prohibited. Youmidor may remove any Content that is manifestly unlawful or contrary to these Terms.
8. Intellectual property
The Service, its brand, logos, interface, databases and all of its elements are protected by intellectual property law and remain the exclusive property of Youmidor or its partners. Any unauthorized reproduction, extraction or exploitation is prohibited without prior written consent.
9. Personal data
Youmidor processes your personal data in accordance with the General Data Protection Regulation (GDPR) and its Privacy Policy, which forms an integral part of these Terms.
You have rights of access, rectification, erasure, portability, restriction and objection, which you may exercise at the address indicated in the Contact section.
10. Availability and changes
Youmidor endeavours to ensure the availability of the Service but does not guarantee uninterrupted or error-free operation. The Service may be subject to maintenance operations, and its features may evolve, be added or removed.
11. Liability
The Service is provided "as is". To the extent permitted by law, Youmidor shall not be held liable for indirect damages, nor for the consequences of decisions made on the basis of the indicative information in the catalogue.
Nothing in these Terms shall have the effect of limiting Youmidor's liability in the event of gross negligence, wilful misconduct, or personal injury, in cases where the law prohibits such limitation.
12. Health and tobacco use
Youmidor is a cataloguing and tasting tool intended for an adult and informed audience. The Service does not encourage the consumption of tobacco. Tobacco abuse is dangerous to health.
13. Suspension and termination
You may stop using the Service and delete your account at any time. Youmidor may suspend or terminate a User's access, with or without notice, in the event of a breach of these Terms or of fraudulent or abusive use of the Service.
14. Amendments to the Terms
Youmidor may amend these Terms to reflect changes in the Service or in applicable regulations. Substantial changes will be notified to you by an appropriate means. Continued use of the Service after they come into force constitutes acceptance.
15. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, you are invited to first contact Youmidor in order to seek an amicable resolution.
In accordance with the French Consumer Code, the consumer may resort free of charge to a consumer ombudsman (mediator). Failing an amicable resolution, the competent courts shall be seised in compliance with the applicable rules of jurisdiction, in particular the provisions protecting consumers.
